Edye C H Captain 5 Rl Irish Rifles

Capt CG Edye 5 Rl Irish Rifles dismissed the service for drunkenness by a Gen C Marshal 3.2.1902. Reemployed as a recruiting officer 1.4.1916 and served in various capacities at home until 1.3.1920. Applied for his South Africa medal on the grounds that the authorities have permitted him to “make good”. Truthfully declared former service.

Ruling – the cases are of course not quite analogous as this officer never received his South Africa medals. Thus he did not “forfeit” a medal so far as he was concerned, it was not in existence. It is recommended however that the principles of the army order be applied (AO383/15). Medal with clasps CC.OFS.1901.1902 issd Iv 073.22.7.20 “The issue of the medal does not enable him to the SA War gratuity."

Ruling by A.A.G on 4/10/20 that if a re-enlisted soldier denied any former service he is not entitled to restoration of medals. If, however, he acknowledged having previously served but did not state the correct unit, medals may be restored.

Offences committed prior to 9.7.02 ie whilst the SAC were considered as soldiers.

Provision of the Royal Warrant 9KR as to forfeiture of Medals (68/SA/8703) cannot be applied to the SAC after 9.7.02. Similarly the provisions relative to restoration of forfeited medals cannot be applied to them after that date.

AG3 15.9.06. The medals cannot be regained unless the man resumes his status as a soldier and completes the necessary service.

Allow medal as he was not tried or discharged till after the conclusion of peace, ie had he been convicted and so discharged, the medal being in his possession there would have been no authority by which his medal could be retaken.
