I'm finding a bit of interesting information but not yet the Act itself.

The 1881 Act detailed a total of 27 capital offences.

12 were punishable by death at any time

15 were punishable on active service only

I came across this Army Order that refers to Waziristan, 1895. Item 6 suggests 1256 relates to a pay anomaly.

WAZIRISTAN, 1894-95.

Her Majesty's troops entered Waziristan to escort the Delimitation Commission. The Waziris attacked them on 3rd
November, 1894, an ^ were punished by forces under the command of Sir William Lockhart

ARMY ORDER. War Office, 1st Sept., 1895.

' 1. Her Majesty has been pleased to command that the India medal of 1854, with a clasp inscribed " Waziristan 1894-5," be granted to all troops employed in the operations in Waziristan, who were on duty beyond Kajnri Kach between the 22nd October, 1894, and the 13th March, 1895, or beyond Jandola or Mirian between the 17th December, 1894, and the 13th March, 1895, both dates inclusive in each case.

' 2. Her Majesty has also been pleased to command that a bronze medal and clasp of similar pattern be issued to all authorised Government followers who accompanied the troops so engaged.

'3. Officers, soldiers and others, who are already in possession of the India medal of 1854, will receive the new clasp only.

* 4. Commanding officers and heads of departments will prepare nominal rolls of the individuals entitled to the medal or clasp, and submit them, in the case of troops serving in the United Kingdom, to the Adjutant-General, Horse Guards ; in the case of troops serving in India, to the Deputy Adjutant-General of the command concerned, and, in the case of troops serving elsewhere, to the Adjutant-General in India, Simla, through the proper channel.

' 5. The rolls of Europeans are to be furnished in triplicate, in the form given in the Appendix, page 12, on foolscap ruled lengthways, and a margin of an inch is to be left on each side of the fold. The names of officers and warrant officers will be entered in order of rank, and those of non-commissioned officers and men in alphabetical order.

' 6. The names of officers and soldiers who, under Articles 613, 1255, 1256 and 1258, Royal Warrant relating to Pay, etc., 1895, have incurred forfeiture of the medal, are to be included in the roll, and in the column headed " Remarks " the reasons which have rendered them ineligible are to be stated.

' 7. All names in the rolls should be written in printed characters, and those of men who have become non-effective by death, transfer, discharge, etc, as well as of those who have forfeited the medal, should be entered in red ink.

' 8. The rolls of natives of India are to be furnished in the manner which may hereafter be prescribed by the Government of India.'

More than a pay anomaly. Para (6) is in my opinion a "catchall" provision where soldiers/officers who incurred forfieture of the medal under a number of articles including the Pay Warrant etc (what is the "etc"?)are dealt with. For our purposes, the notation supposed to be entered in the "remarks" column is not always there.
Best regards
IL.

Three of the men (Parry, Richards and Steele) I know about and it is likely that the QSA was withheld for inciting mutiny (even though they were released after a few months because the Army had convicted them under the wrong charge). Nevertheless, officially they were denied a medal under Article 1255. I would like to see the wording of Article 1255 which presumably deals with mutiny but as these men were released without serving their sentence which was quashed I would be interested to see how the Army avoided issuing the QSA to them.

Some three others were also denied medals: One was denied under Article 1256 (a) and two under Article 1256 (b).

Now, forgive me for my ignorance but where will I be able to find the wording of all these Articles? I do not have a clue why these fellows were denied their medal award so the reasons given in 1256 (a) or (b) will be most illuminating.

Hi Guys
I have resurrected this old post as a QSA to 3533 J Byrne 8th K. R. I. Hussars I recently acquired, has "NO MEDAL" in the Roll. The medal was forfeited under Article 1256 (A) R.W. However he was subsequently awarded the medal and a 1901 clasp on the 1903 Roll ? The said medal I have has the CC and OFS clasps fixed but with Belfast and 01 clasps loose on ribbon.
Can anyone come up with an explanation why the medal was reissued a year after being forfeited and has anyone found out what Article 1256 (A) R.W. relates to?
Regards
Brian

Hi Brian,
The Victoria Barracks Historical Society located in Fortitude Valley, Brisbane,Queensland has an extensive library that may include the AO’s you are looking for. I am no longer a member, don’t have a contact there and live two days good drive away so I am no help other than the possibility they may assist.
Some years ago I used their library and it contained many AO’s etc for WW1 so it is worth a try.
Cheers,
Jim
